Terms & Conditions

This Terms & Conditions Agreement ("Agreement") is entered into between Emerita Colon, hereinafter referred to as the "Service Provider," and the client, hereinafter referred to as the "Client," who seeks services. 

1. Services Provided:

The Service Provider agrees to provide services to the Client as per the agreed-upon terms, which may include but are not limited to readings, written and audio content, classes, workshops, and spiritual guidance sessions.

2. Client Responsibility:

The Client acknowledges and agrees to cooperate with the Service Provider during the reading session. The Client understands that the effectiveness of the consultation may be influenced by their level of openness, honesty, and receptiveness.

The Client acknowledges and agrees to fully engage with the class or service. The Client understands that the effectiveness of the service or class may vary due to their level of participation and engagement. 

The Service Provider is not a licensed therapist or financial advisor. The Client acknowledges that their services should not replace professional advice. 

3. Right to Refuse Service:

The Service Provider reserves the right to refuse service to any Client for any reason deemed appropriate by the Service Provider. This includes but is not limited to situations where the Service Provider feels uncomfortable or believes that the Client may not benefit from the session or workshop. 

4. No Guarantees:

The Client acknowledges that readings are regarded as entertainment only. The Service Provider does not guarantee specific outcomes from readings or content. 

The Client takes full responsibility for their actions in regard to the information and content of the session. 

5. Payments

Payments on this site are processed through Squarespace, Acuity, and Square. By using the site for payments, The Client agrees to their current terms of service.

The Client authorizes The Service Provider to charge their payment card for all purchases according to their selected payment option.

Completion of a payment transaction is subject to your provision of accurate information and authorization by your card company.

The Service Provider reserves the right to cancel a payment, with notice, for reasons including breach of law, violation of these terms, suspicion of fraudulent activity, excessive disputes, or failure to cooperate in an investigation.

The Service Provider is not responsible for performance or service problems caused by the payment processing websites, Squarespace, Acuity, or Square.

The Client acknowledges that one coupon code or affiliate code can be applied to a sign-up at a time and that coupon codes and affiliate codes cannot be retroactively added to a preexisting sign-up.

6. Refund, and Rescheduling Policy:

There are no refunds for any services unless the Service Provider cancels on their end due to illness, emergency, or other reasons. The Client is responsible for the full payment of the service, regardless of their level of satisfaction or disagreement with the results.

Rescheduling without a fee is available up to 24 hours before the scheduled session.

Rescheduling within the 24-hour window is only permitted for serious illness. The Client agrees to email the Service Provider as soon as possible if they are unwell and unable to make the session it's within the 24-hour window.

If The Client wishes to reschedule within the 24-hour window or does not attend their session at the scheduled time for other reasons, they will be subject to a $20 fee to reschedule the session. If The Client is 10 minutes late or more, the session will end and The Client may be subject to the $20 fee to reschedule the session. 

7. Confidentiality and Privacy:

The Service Provider respects your privacy. The Service Provider agrees to keep all information disclosed during sessions and workshops confidential. The Client's personal information and the details of their reading will not be shared with any third party without the Client's explicit, written consent.

8. Content Usage and Intellectual Property:

The Client acknowledges that all content on this website, including but not limited to written articles, blogs, and podcasts, is the intellectual property of Emerita Colon. Unauthorized reproduction or distribution is prohibited. 

Soy Emmy, the Soy Emmy logo, and all related marks are the property of Emerita Colon. Unauthorized use is strictly prohibited.

9. User Conduct

The Client acknowledges and agrees that they must conduct themselves respectfully and responsibly when engaging with The Service Provider’s platform.

The Client acknowledges hate speech, harassment, or any form of inappropriate behavior will not be tolerated.

10. Limitation of Liability:

The Client agrees that Emerita Colon is not liable for any direct, indirect, incidental, special, or consequential damages resulting from the session. 

11. Amendments:

The Service Provider reserves the right to amend these terms at any time without prior notice. The Client is responsible for reviewing the terms periodically for any changes.

12. Governing Law:

This Agreement shall be governed by and construed in accordance with the laws of Illinois, without regard to its conflict of law principles.

By engaging in a session, product, or course with the Service Provider, the Client acknowledges that they have read, understood, and agreed to all terms and conditions outlined in this Agreement.
